PROBATE & TRUST ADMINISTRATION FEE SCHEDULE
Probate: Full Administration, based on the value of estate assets, including homestead:
- Estates up to $100,000: $3,000
- $100,000 to $1,000,000: 2% (statutory fee is 3%)
- $1,000,000 to $3,000,000: 1.5% (statutory fee is 2.5%)
- $3,000,000 to $5,000,000: 1% (statutory fee is 2%)
- $5,000,000 to $10,000,000: .75% (statutory fee is 1.5%)
- Over $10,000,000: .5% (statutory fee is 1%)
- Services for litigation, tax matters, carrying on the decedent’s business and other extraordinary services are billed hourly.
Trust Administration Fees, based on value of trust assets, including homestead:
- Trusts up to $100,000: $2,500
- $100,000 to $1,000,000: 1.25% (statutory fee is 2.25)
- $1,000,000 to $3,000,000: 1% (statutory fee is 1.875%)
- $3,000,000 to $5,000,000: .75% (statutory fee is 1.5%)
- $5,000,000 to $10,000,000: .5% (statutory fee is 1.125%)
- Over $10,000,000: .25% (statutory fee is .75%)
- Services for litigation, tax matters, tax planning, special valuation of assets and other extraordinary services are billed hourly.
Probate: Summary Administration: $2,500
- Notice to Creditors: $500
Fees for Estate Tax Returns (same as statutory fee):
- Assets up to $10,000,000: .5%
- Assets over $10,000,000: .25%
- Returns solely for deceased spouse unused exemption: 50% of statutory fees.
